STATEMENT OF CLAIM:

“Claim of the System Committee of the Brotherhood that:

1. The Agreement was violated when on December 23, 2016, the Carrier failed to call and assign Messrs. M. Corzine and J. Derossett, who were both regularly assigned to track foreman positions within the Track Subdepartment and instead called and assigned Track Inspector M. Schultz and Machine Operator S. Lipe, to repair a section of rail at Mile Post 31.3 on the Bluford South Subdivision [System File C 16 12 23 (137)/IC-BMWED- 2017-00014 ICE].

   
   

2. As a consequence of the violation referred to in Part 1 above, Claimants

M. Corzine and J. Derossett shall now be ‘… allowed thirteen (13) hours at the time and one-half rate of pay at the Foremans (sic) rate which totals $587.34 for the Claimants.’ (Emphasis in original) (Employes’ Exhibit ‘A-1’).”

FINDINGS:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.

At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.

AWARD

Claim dismissed.
