“Claim of the System Committee of the Brotherhood that:
The Carrier violated Rule 25(c) of the Agreement when, on August 31, 2017, it sent Claimant J. Shepard home and allowed a junior employe to stay and assume the Claimant’s assigned foreman duties at Mile Post
159.9 in Scales Mound, Illinois, until the following morning [System File 17 08 31 (047)/IC-BMWED-2017-00080 ICE].
As a consequence of the violation referred to in Part 1 above, Claimant
J. Shepard shall now be compensated for ‘… three (3) hours at the time and one-half rate of pay, and eight (8) hours at the double time rate of pay which totals $.617.46.’ (Emphasis in original) (Employes’ Exhibit ‘A- 1’).”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934. Public Law Board 6043 has jurisdiction over the parties and the dispute involved herein.
At a hearing before the Board, the parties jointly advised that this claim has been settled on the property and requested an Award showing it was dismissed.
Claim dismissed.
