STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
1. The Carrier violated the Agreement when it failed to bulletin positions
On the system construction crew at Derby and when, it failed to pay
per diem expenses to Messrs. F. Rolf, G. McMannus, M. Sprague,
M. Veysey, J. Tarr, R Mayberry, B. Boone, D. Cousains, B. Russell,
J. Clark, D. Goff, K. Welch, J. Beaudry, D. Lyford, K. Russell,
C. Bracket, R Robertson, R Porter, and A Cullen beginning January 3
and continuing through April 12, 2000.
2. As a consequence of the violation referred to in Part (1), Claimants
F. Rolf, G. McMannus, M. Sprague, M. Veysey, J. Tarr, R Mayberry,
B. Boone, D. Cousains, B. Russell, J. Clark, D. Goff, K. Welch,
J. Beaudry, D. Lyford, K. Russell, C. Bracket, R Robertson, R Porter,
and A. Cullen and any other employee who worked on the system
construction crew, shall not be paid per diem expense for each day
worked on system construction crew at Derby beginning January 3
and continuing through April 12, 2000.
FINDINGS:
During the hearing, the parties reached a resolution of Case No. 2, which was
therefore withdrawn.
