STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

1. The Agreement was violated when the Carrier failed to call and assign Trackman M.D. Burpee for trackman service work at a derailment at North Twin on the Millinocket Section Territory on February 21, 22, 23, and 24, 2000 and instead called assigned junior employees D. Goff and/or R. Robinson.

2. As a consequence of the violation referred to in Part (1) above, Claimant Burpee shall be compensated for twenty-four (24) hours' pay at his respective straight time rate of pay and for twenty-five (25) hours' pay at his respective time and one half rate of pay and for eight (8) hours' pay at his respective double time rate of pay.

FINDINGS:

During the hearing, the parties reached a resolution of Case No. 3, which was

therefore withdrawn.
