 STATEMENT OF CLAIM:

    In connection with the objections raised during the hearing, the reasons stated in this appeal and furthermore violations of the Agreement, this is an appeal of discipline assessed [dismissal] to BMWED employee D. D. Carter, as a result of the hearing held on August 22, 2006. . .it is respectfully [sic] that the charge letter and all matters relative thereto be removed from Mr. Carter's personal file, and he be made whole for all losses suffered as a result of the Carrier's action.


    Subsequent to the hearing in this matter, the Board was advised that the case had been


withdrawn from the jurisdiction of the Board.

                        AWARD


    Case dismissed based upon withdrawal of the claim from the jurisdiction of the Board.
