STATEMENT OF CLAIM: "Claim of the System Committee of the Brotherhood that:
1. The Carrier violated the Agreement when on January 11, 2008, it dismissed
Mr. M. Stamm for his alleged violation of the October 5, 1977,
Absenteeism Agreement.
2.
FINDINGS:
As a consequence of the violation cited in Part 1 above, Mr. M. Stamm
shall now be reinstated to service with all rights unimpaired and he shall be
compensated for all loss suffered."
When the parties arrived at the oral argument with respect to this case, they both
agreed that the above-entitled case had been settled on the property. Consequently, this
case shall be dismissed.
AWARD:
The claim is dismissed.
