STATEMENT OF CLAIM:
l. The Agreement was violated when, on April 13, 15 and 16, 2012, the Carrier as signed Welder J. Hunter to flag for a rail grinding train at Mile Post OBA 239.5 on the Nashville Division and failed to properly assign such work to Claimant C. Scott.
2. As a consequence of the violation referred to in Part 1 above, Claimant C. Scott shall now be compensated sixteen (16) hours at his straight time rate, and twenty-eight
(28) hours at his overtime rate.
FINDINGS:
The Board, upon consideration of the entire record and all of the evidence, finds that the parties are Carrier and Employee within the meaning of the Railway Labor Act, as amended, that this Board is duly constituted by Agreement dated March 20, 2008, this Board has jurisdiction over the dispute involved herein, and that the parties were given due notice of the hearing held.
The parties have advised the Board that this dispute has been settled on the property. As there is no longer a matter in controversy, the claim must be dismissed.
AWARD: Claim dismissed.
