STATEMENT OF CLAIM:

I. The Agreement was violated when, on March 9 and 10, 2020 , the Carrier assigned Bridge and Building Assistant Foreman T. Metcalf to perform work providing flagging protection for a rail gang in the vicinity of Mile Post Z 266.4 to Mile Post Z 275.0 instead of Assistant Foreman - Flagman J. Burleson (System File 2020-03/20-98994 CSX).

2. As a consequence of the violation referred to in Part 1 above, Claimant J. Burleson shall now be compensated for ' ... (16) hours straight time and (13) hours overtime at the respec tive Assistant Foreman Flagman (Track) rates of pay. ***'

FINDINGS:

The Board, upon consideration of the entire record and all of the evidence, finds that the parties are Carrier and Employee within the meaning of the Railway Labor Act, as amended, that this Board is duly constituted by Agreement dated March 20, 2008, this Board has jurisdiction over the dispute involved herein, and that the parties were given due notice of the hearing held.

The parties have agreed to settle the claim herein. As there is no longer a matter in con troversy, the claim must be dismissed.
