STATEMENT OF CLAIM
“Claim of the System Committee of the Brotherhood that:
The Carrier violated Rule 22 of the Agreement when it failed to offer and assign Mr. S. Johnson to perform overtime track protection work piloting the Loram Rail Grinding Train on the Missabe Subdivision between Mile Posts 39 and 6.6 on May 13, 16, 17, 18, 19, 20, 23, 24, 25, 26 and 27, 2016 and instead assigned employe C. Sheasby thereto (Carrier’s File WC-BMWED-2016-00040 WCR).
As a consequence of the violation referred to in Part 1 above, Claimant S. Johnson shall be compensated one hundred ten (110) hours’ pay at the overtime rate.”
The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934.
Public Law Board 7566 has jurisdiction over the parties and the dispute involved herein.
Claimant was given proper notice of the hearing in the instant claim.
