STATEMENT OF CLAIM

“Claim of the System Committee of the Brotherhood that:

1. The Carrier violated the Agreement when it failed and refused to compensate Mr. G. Luther at the overtime rate of pay for hours he was instructed to work outside his regularly assigned work period on February 10, 11, 12, 13, 14, 17, 19 and 20, 2014 (Carrier’s File WC- BMWED-2014-00013 WCR).

2. As a consequence of the violation referred to in Part 1 above, Claimant G. Luther shall now be compensated fifty-six (56) hours at his respective overtime rate of pay.”

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934.

Public Law Board 7566 has jurisdiction over the parties and the dispute involved herein.

Claimant was given proper notice of the hearing in the instant claim.
