STATEMENT OF CLAIM: “Claim of the System Committee of the Brotherhood that:

1. The Carrier violated Rule 22 of the Agreement when it failed to call and assign Mr. C. Okeson to perform overtime trackman duties removing snow on the Waukesha Subdivision around Silver Lake, Wisconsin on Saturday, February 2, 2013 and instead called and assigned employe A. Hegeman thereto (Carrier’s File WC-BMWED-2013-00004 WCR).

   
   

2. As a consequence of the violation referred to in Part 1 above, Claimant C. Okeson shall be compensated five (5) hours’ pay at his respective time and one-half rate of pay.”

Findings:

The carrier or carriers and the employee or employees involved in this dispute are respectively carrier or employee within the meaning of the Railway Labor Act as approved June 21, 1934.

Public Law Board 7566 has jurisdiction over the parties and the dispute involved herein. Parties to said dispute were given due notice of hearing thereon.

The Carrier and Organization resolved the matter at the hearing.
