STATEMENT OF CLAIM:

1. Carrier violated the terms of the prevailing Telegraphers' Agreement, when by reason of changing his assigned hours and rest days, it caused Clerk-Telegrapher J. H. Whiteside,.Rector, Arkansas, to lose a calendar day's pay on Thursday, May 24, 1956.

2. in consequence of its action, Carrier shall now compensate Mr. J. H. Whiteside for eight hours at the pro rata rate of pay of the Clerk-Telegrapher position, Rector, Arkansas, for Thursday, May 24, 1956.

        FINDINGS: Under the facts in this case it is developed that claimant lost no time because of change in the starting hours of his assignment.


AWARD: Claim denied.
