STATEMENT OF CLAIM:

1. That Carrier violated the Telegraphers' Agreement when, on the 13th day of March, 1956, at or about 4:20 P.M<, it caused, required or permitted Conductor Stewart, a train service employe not covered by the Telegraphers' Agreement and having no rights thereunder, to receive, copy and handle train order (No. 745) at McNeil, Arkansas:

        "Reduce speed to 30 MPH MP 344 pole 20 to pole 25 soft track."


2. That Carrier shall compensate Extra Telegrapher F. A. 8owen for one day (8 hours), March 13, 1956, at the rate of $2.01 an hour, as a result of the violation aforesaid.

        FINDINGS: There is no dispute but what the order copied by the conductor here was a train order. There was no emergency involved here.
