STATEMENT OF CLAIM
:
1. Carrier violated the Scope and other rules of the prevailing Agreement between the parties hereto when and because it refused to fill the position of Agent
at Paragould, Arkansas, with an employee from the Telegraphers' seniority roster
during the period from July
4, 1955
to July
25, 1955
(three weeks), while the regular Agent was absent from his station on vacation, and instead required an employee
not covered by the Telegraphers' Agreement and having no rights thereunder to take
over and assume the duties of Agent at this station during the said period of time.
2.
In consequence of its action in thus violating the Agreement, Carrier shall
be required to make redress in the form of a day's pay at the Paragould agency rate
of pay
($460.21
per month) for each day involved in the period, July
4-25, 1955,
to
the senior employe on the Telegraphers' roster not working on each day such violative
arrangement was in effect,
FINDINGS
: The above claim was withdrawn by the Organization.
AWARD
: Claim dismissed.
