STA3EVENT OF CLAIM:

1. Carrier violated the terms of the Agreement between the parties when on June 30, 1956, it failed to assign extra telegrapher W, H. Flowers to perform the work on the Saturday rest day of telegrapher position held by W. E. Matthews at Pine Bluff, Arkansas relay office, with assigned hours 8:00 A.M. to 4:00 P.M.

2. Carrier shall not, compensate W. H. Flowers for eight hours pay at the time and one-half rate for June 30, 1956, which he would have been paid if he had been permitted to perform the work on the rest day of the position to which he was entitled.

FINDINGS: There was an extra man performing extra work in this office who was avail
able and competent to perform this extra work and who would not otherwise
have had 40 hours work in his work week.

Under the facts and circumstances involved in this case, this claim should be sustained.
