ORDER OF RAILROAD TELEGRAPHERS
and
MISSOURI PACIFIC RAILROAD COMPANY
Claim of the General Committee of The Order of Railroad Telegraphers on the
Missouri Pacific Railroad that:
1. Carrier violated the provisions of the agreement between the parties
by failing to maintain the higher rates in the office when the force
was reduced at Hughes, Arkansas, January
14, 1956.
2.
Carrier shall now be required to properly adjust the rate of the
agency position at Hughes, Arkansas, by an increase of
7
cents per
hour retroactive to January
14, 1956.
OPINION OF BOARD: While existing facts in this claim are not identical with those
present in Docket No.
52,
said claim under consideration here '
involves the same parties and the same rules as were present in Docket No.
52,
Award
No.
52,
previously considered and adopted by this Board.
It is the opinion of the Board that the controlling factual situation here
present, when considered in the light of the cited rules, is comparable to that considered and applied in the aforesaid award.
In the instant case, however, in view of the fact that there were only two
positions at this station, namely, the position of Agent-Telegrapher carrying a rate
of
1.635
per hour and the position of Telegrapher-Cashier carrying a rate of
,1.705
per hour, each of which were assigned to the first trick prior to the abolishment of
the Telegrapher-Clerk position on January
14, 1956.
The higher rate of
$1.705
shall be applied to the remaining position at the
station. Other than as to this distinction, this claim is valid for the reasons
stated and to the extent and in the manner indicated in Award No.
52.
FINDINGS: The Special Board of Adjustment No.
117,
upon the whole record and all the
evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively
Carrier and Employes within the meaning of the Railway Labor Act as approved June 21,
1934.
That this Special Board of Adjustment has
jurisdiction over
the dispute
involved herein; and,
That the Carrier violated the effective agreement.
