AWARD IN DOCKET NO. 11
STATEMENT 1. Carrier violated the agreement between the parties hereto
OF CLAIM:
when on August 8, October 4, 11, 18 and 31, and November 29,
1953, respectively, it caused, required and permitted train
service employees not covered by the Telegrapher's Agreement,
to handle (receive, copy and deliver) train orders at Kilarm
Junction, West Virginia, which work was and is reserved solely
to employees covered by the Telegraphers' Agreement.
2. Carrier be required to compensate the senior idle telegrapher
(extra in preference) for one day's pay (8 hours) on each date
shown above.
FINDINGS: This claim is similar to that involved in Docket 16 and involves
the copying of train orders at Kilarm Junction by train crews either directly
from the dispatcher or from the operators at Chiefton on days when offices at
either Monongah or Willard were closed. Under the 1938 Agreement it is immaterial
whether the orders were copied directly from the dispatcher or the operator.
The office at Chiefton being open on the dates for which claim is made for the
reasons stated in our Findings in Docket 16 we find no basis for a sustaining
award here.
