Parties: THE ORDER OF RAILROAD TELEGRAPHERS
THE BALTIMORE AND OHIO RAILROAD COMPANY

STATEMENT 1. Carrier violated the Agreement between the parties
OF CLAIM: hereto when on March 31, 1951, it caused, required
and permitted train service employees not covered by
the Telegrapher's Agreement to handle (receive, copy,
and deliver) train orders at Panther Creek and Fenwick,
West Virginia, on the said date, which work was and is
reserved solely to employees covered by the Telegrapher's
Agreement.
2. Carrier be required to compensate the senior idle teleg
rapher (extra in preference) for one day's pay (8 hours)
for each violation on March 31, 1951 at Panther Creek
and Fenwick, West Virginia.

FINDINGS: These claims are made because of copying train orders by train crews at the same locations as were involved in Docket 10 (Fenwick) and Docket 19 (Panther Creek). For the reasons set forth in our Findings in those dockets we find no basis for a sustaining Award here.

AWARD Claims (1) and (2) denied.

                      Francis J. Robertson,

                      Chairman
