STATEMENT 1. Carrier violated and continues to violate the Agreement be
OF CLAIM: tween the parties hereto when on October 12, 20, 21, November 1,
2, December 17, 1954, and subsequent dates at Frosts, Ohio, it
caused, required and permitted train service employees not
covered by the Telegraphers' Agreement to handle (receive, copy
and deliver) train orders, which work was and is reserved solely
to employees covered by the Telegraphers' Agreement.
2. Carrier be required to permit a joint check of its records
to determine the number of violations occurring at Frosts, Ohio,
subsequent to the foregoing dates.
3. Carrier be required to compensate the senior idle telegrapher
(extra in preference) for one day's pay (8 hours) on each and
every date shown above and on all subsequent dates on which a
joint check shows our Agreement to have been violated at Frosts,
Ohio.
FINDINGS: The copying of train orders here complained of took place at
Frosts, Ohio at the end of a passing siding. No telegraph operator has been
employed at Frosts for at least 30 years. For the reasons stated in our Findings
in Docket No. 1 we find no basis for a sustaining award here.
