STATEMENT 1. Carrier violated the agreement between
OF CLAIM: the parties hereto when, on April 15, 1953,
it caused, required and permitted train
service employees not covered by the
Telegraphers' Agreement to handle (receive,
copy and deliver) train order No. 418 to
Eng. 4327, Eng. 4838 assisting at Halltown
via Millville.
2. Carrier be required to permit a joint check
of its records to determine the number of
violations occurring subsequent to the
foregoing date.
3. Carrier be required to compensate the senior
idle telegrapher (extra in preference) on
the date shown above, and on all subsequent
dates on which a joint check of records shows
agreement to have been violated.

FINDINGS: On a trip from Winchester to Brunswick, at Winchester an operator issued a train order to a two engine train crew to run extra to Halltown an intermediate point. At Halltown the conductor copied another 'train order to proceed to Harper's Ferry, another intermediate point. There is no telegraph office at Halltown. There is a passing siding at that location. This is the only instance shown of the copying of a train order at Halltown.

The facts here are analagous to those involved in Dockets 1 and 19. For the reasons stated in our Findings in thos=Dockets we find no basis for a sustaining Award here.
