STATEMENT
OF CLAIM:
1. Carrier violated the agreement between the parties hereto when
on June 16, 17, 18, 23, and 24, 1954, respective,, it caused, required
and permitted a -section foreman, an employee not covered by Telegraphers'
Agreement, to handle rece ve, copy and deliver) track car line-ups Forms
1089-D at Richmond, West Virginia, which work was and is solely reserved
to employees covered by the Telegraphers' Agreement.
2. Carrier be required to compensate Mr. Cutlip who was working as
agent-operator at Richwood on the dates listed, one special call for each
date shown.
FINDINGS:
The parties have agreed that whatever decision the Board reached in
its Award on Docket No. 43 would be applicable to this case. Accordingly,
the claim is sustained.
