AWARD IN DOCKET NO. 43
STATEMENT
OF CLAIM:
1. Carrier violated the agreement between the parties hereto when
on May 7, 10, 11, 13; 14, 17, 18, 19, 20 and 24, 1954, respectively, it
caused, required and permitted its Section Foreman, an employe not
covered by the Telegraphers' Agreement, to han-cLe-(receive, copy and
deliver) track car line-ups at Richwood, West Virginia, which work was and
is reserved solely to employes covered by the Telegraphers' Agreement.
2. Carrier be required to compensate the employe who was working as
agent-operator at Richwood on the dates listed one special call for each
and every date shown above.
FINDINGS:
Except for the location involved the facts forming the basis for this
claim are practically identical and with those involved in Docket No. 33.
For the reasons stated in our Findings in that Docket we find that this
claim should be sustained.
