THE BALTIMORE AND OHIO RAILROAD COMPANY
AWARD IN DOCKET No. 45
STATEMENT
OF CLAIM:
1. Carrier violated the agreement between the parties hereto
when on
April 1, 2, 3, 7, 8, 10, 13, 14, 15, 17, 20, 21, 22, 24, 29,-May 1, 4, 6,
13, 19, 20, 21, 25, June 2, 5, 8, 10, 11, 12, 15, 16, 29, and July 3, 1953,
it caused, required and permitted section foremen, employes not covered by
the Telegraphers' Agreement, to handle (receive, copy and deliver) track car
line-ups at Tipp City,
Ohio, which
work was and is solely reserved to employes
covered by the Telegraphers' Agreement.
2. Carrier be required to compensate Agent-Operator G. E. Schiller, Jr.,
who was working as agent-operator at Tipp City on the dates listed, one special
call for each and every date shown above.
FINDINGS:
Except for the location involved the facts forming the basis for this
claim are practically identical with those involved in Docket No. 33. For
the reasons stated in our
Findings in
that Docket we find that this claim
should be sustained.
