AWARD IN DOCKET N0. 50

STATEMENT OF CLAIM:

1. Carrier violated the agreement between the parties hereto when on March 19, 1951, at 3:54 P.M., and on March 20, 1951, at 9:49 A.M., it caused, required and permitted, on March 19 a section foreman and on March 20 a signal maintainer, employees not covered by the Telegraphers' Agreement, to handle (receive, copy and deliver) track car line-ups at Wolf Summit, West Virginia, which work was and is reserved solely to employees covered by the Telegraphers' Agreement.

2. Carrier be required to compensate the senior idle telegrapher (extra in preference) one call on each date shown above.

FINDINGS:


at Wolf Summit, West Virginia was discontinued as a train order station, the
second and third trick operators' positions were abolished and an AOB position,
hours 8 A.M. to 5 P.M., was retained. On March 19 and 20th, 1951, a section
foreman and a signal maintainer respectively obtained track car line-ups over
the telephone at Wolf Summit.

For the reasons set forth in our Findings in Docket No. 33 we find a sustaining Award is indicated here. We find that the claim should be sustained on the basis of a special call on behalf of the Operator at Wolf Summit on each of the above listed dates instead of for the senior idle Operator for one day's pay as claimed.
