STATEMENT
OF CLAIM:
1. Carrier violated the agreement between the parties hereto when on
December 10, 11, 13, 18, 19, 20, 26, 27 and 28, 1950, and January 10, 11
and 17, 1951, and all future dates, it caused, required and permitted section
foremen, employees not covered by the Telegraphers' Agreement, to handle
(receive, copy and deliver) track car line ups at Orlando, West Virginia,
which work was and is reserved solely to employees covered by the Telegraphers'
Agreement.
2. Carrier be required to compensate the senior idle telegrapher (extra
in preference) one day's pay (8 hours) on each and every date shown above,
and all subsequent dates on which a joint check of the records shows the
agreement to have been violated.
FINDINGS:
Except for the date of the abolishment of the telegrapher's position
and its location this claim is practically identical with that involved in
Docket No. 32. For the reasons stated in our Findings in that docket we find
the following:
AWARD
Claim (1) sustained. Claim (2) sustained except in so far as a joint
check is requested.
