STATEMENT
OF CIAIM:
1. Carrier violated the agreement between the parties hereto
when, on January 12, 1955, it caused, required and permitted
Engineer Runkles on helper engine 265 to report his arrival
at Gaithersburg, Maryland, and to copy Train Order No. 406 at
that point,' which work was and is solely reserved to_employees
covered by the Telegraphers' Agreement.
2. Carrier be required to compensate the senior idle telegrapher
(extra in preference) for pay for one day (8 hours) on January 12,
1955.
FINDINGS: A helper engine assisting a train eastwardly from Point of Rocks
to Gaithersburg, Md., was unable to turn at that point because of the wye
being inoperative. The engineer of the helper called the Operator at Point
of Rocks to secure permission to operate the diesel back to Point of Rocks
with train control inoperative. There has never been any Telegrapher's
position at Gaithersburg.
This appears to be the only claim of its kind at Gaithersburg,
despite the fact that helper service has been operating to that point for
many years. For the reasons set forth in our Findings in Dockets 1 and
19 we find no basis for a sustaining award.
