STATEMENT 1. Carrier violated the agreement between the parties hereto
OF CLAIM: when, on December 22, 1954, it caused, required and permitted
Engineer Long on helper engine 184 to report his arrival at
Gaithersburg, Maryland; to report Passenger Extra 963 East,
No. 31 Eng. 63 and Extra 969 West by Gaithersburg and to
handle (copy, receive and deliver) Form A to cross from No. 2
to No. I track and proceed west.
2. Carrier be required to compensate the senior idle teleg
rapher (extra in preference) for pay for one day (8 hours)
on December 22, 1954.
FINDINGS: This case is similar to Docket 55. Here a helper engine
assisted a train east to Gaithersburg. Inasmuch as the helper
was close to the time of trains following and a westward train the engineer
called the operator at Point of Rocks to secure permission to cross over at
Gaithersburg. He also reported to the Operator at the latter's request
that a passenger extra east had passed and that a westward freight had
passed. The Carrier asserts that he was not instructed to report the pass
ing of any trains. Further, the Carrier asserts and it is not denied that
for many years helper engines have secured permission from the operator at
Point of Rocks to cross over at Gaithersburg in this same manner for many
years without complaint.
_For the reasons given in our Findings in Docket 55 we find no
basis for a sustaining Award in this case.
