STATEMENT 1. Carrier violated the agreement between
OF CLAIM: the parties hereto when on January 14 and
March 15, 16, 19 and 20, 1951, it caused,
required and permitted the conductor on
Trairi No. 343 to report its arrival at
Rachel, West Virginia, which work was and
is reserved solely to employees covered by
the Telegraphers' Agreement.
2. Carrier be required to compensate the
senior idle telegrapher (extra in preference)
for pay for one day (8 hours) on each day
and date shown above.

FINDINGS: On the dates of claim the conductor of Train
No. 343 reported his arrival at Rachel, W. Va. There is a passing
siding at Rachel which is 3.8 miles west of Farmington where
there was an open telegraph office at the time of claim. The last
telegrapher's position at Rachel was abolished about 1903.

For the reasons stated in our Findings in Dockets 1 and 19 we find no basis for a sustaining Award here.
