STATEMENT 1.- Carrier violated the agreement between the parties
OF CLAIM: hereto when on May 26, 1955 it caused, required and
permitted the Conductor of Eng. 11547. to copy Train Order
No. 35 at Richland, Ohio, via West Junction, Ohio. The
conductor being an employee not covered by the Teleg
raphers' Agreement.
2. Carrier be required to compensate the senior idle
telegrapher (extra in preference) for pay for one day
(8 hours on May 26, 1955.)
FINDINGS: At Richland, Ohio a conductor of a work train holding an
order to work on the territory west of Hamden copied a
train order from the operator at West Junction. There has never been
a telegraph office at Richland. Only this one isolated instance of
copying train orders at that point is shown.
For the reasons stated in the Findings in Dockets 1 and
19 we find no basis for a sustaining award here.
