STATEMENT OF CLAIM:

THE ORDER OF RAILROAD TELEGRAPHERS
THE STATEN ISLAND RAPID TRANSIT RAILWAY COMPANY

AWARD IN DOCKET N0. 96

1. Carrier violated the agreement between the parties hereto when effective on
or about May 3, 1955, it permitted members of train and engine crews, employees not covered
by the Telegraphers' Agreement to handle, (receive and deliver) their train orders and
other instructions over the telephone at the Passenger Station from the train dispatchers,
yard masters and Company Officials, and to report to the train dispatcher the time of the
arrival and departure of their trains. The orders and instructions received by train and
engine service crews at Arlington Passenger Station are verbal instructions.

2. Carrier be required to permit a joint check of its records to determine the number of violations occurring subsequent to May 3, 1955.

3. Carrier be required to compensate the senior idle telegrapher or telegraphers necessary to eliminate said violations for one day's pay (8 hours) on the date shown above, and all dates on which a joint check of records shows Telegraphers' Agreement to have been violated.

FINDINGS:

The claim here in volves the same type of work as was involved in our Award No. 94. For the reasons states in our Findings in that case we find no basis for a sustaining award here.
