BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of the Brotherhood of
Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes on the Missouri Pacific Railroad, that the Carrier
violated the Clerks? Agreement:
1.
When, effective
on January
30, 1955
and thereafter, it
assigned the clerical work consisting of -
(a) Making a check of freight trains departing from
Concordia, Kansas;
b) Compiling outbound switch lists;
~c) Writing up (compiling) wheel reports,
to Agent-Telegrapher or Telegrapher, who are another class
of employes and are outside the Clerks? Agreement and who
hold no seniority rights thereunder entitling them to said
-work;

Clerk A. M. Cherin,ton be allowed pay for time claimed on
the claim dates during January, February and March,
1955,
as set forth in Claim Statement, attached hereto and made
a part hereof, which claims are continuing each day that
violation of Agreement occurs subsequent to March
31, 1955,
until the dispute is disposed of and the claims satisfied.
FINDINGS: For over 40 years conductors and trainmen had been checking their
outbound trains and writing up the switch lists and wheel reports
at Concordia. On January
25, 1955,
they were relieved of such duties and
same were assigned to the Agent and Telegrapher Clerks.
It is generally recognized that clerical work can properly be
assigned to Agents and Telegraphers to fill out their tour of duty. Since
the work had never been performed by clerks, it does not appear that such
assignment was a violation of the Clerks? Agreement.
