STATEMENT OF CLAIM:

"Claim of the System Committee of the Brotherhood that:

1)(1) Carrier violated rules of the current Agreement with the Brotherhood of Railway Clerks =when it established, without negotiation or agreement with the Brotherhood, position of Chief Clerk to Auditor of Passenger and Car Service Accounting.

"(2) Carrier shall now compensate the occupant of this position at a rate in accordance with those established for other supervisory positions in the Accounting Department listed in Supplement IS' of our current Agreement, effective July 1, 1955.11 , FINDINGS: On July 1, 1955, upon consolidation of the offices of Passenger Accounting and Car Service Accounting there existed positions of Chief Clerk in each office at the same rate.

The position of Chief Clerk of Car Service Accounting was abolished and his duties were assigned to the employe who had held the position of Chief Clerk, Office of Passenger Accounting. The consolidated position was given the name of Chief Clerk to the Auditor of Passenger and Car Service Accounting,

Claim is made for higher rate in accordance with rates of other supervisory positions.

Patently the position of Chief Clerk to Auditor Passenger and Car Service Accounting was comprised of new duties gathered from both the positions which had been consolidated and it was given a new title. Consequently there should be negotiations and agreement to provide a rate for the new position in accordance with Rule 53 and Supplement S of the Agreement.
