STATEMENT OF CLAIM : Claim of the System Committee of the Brotherhood:

(1) That-Carrier violated and continues to violate the Clerks? current Agreement when, on March 25, 1954; it began using a Telegrapher, an employee not covered by Rule 1, Scope Rule, of the Clerks? Agreement to perform some of the regularly assigned duties of regularly assiped Car Clerk J. He Clarkston's position while the incumbent was required to lay aside those duties and perform Yard Clerk work, following the abolishment of the Yard Clerk position, effective with the completion of tour of duty 71:55 P.M., March 25, 1954, at the Tyler, Texas, Yard Office.

(2) That Charles Pappas, Jr., who was displaced from a regular assignment and forced to the extra board, and his successors if there be any, be paid a day?s pay at pro rata rate of third shift Yard Clerk from March 25, 1954, to date the violation is corrected.



FINDINGS : In reduction of force, Yard Clerk position was abolished and his
duties assigned to the car clerk, whose duties were performed in the
same office with a clerk-telegrapher. Apart of the car clerk?s duties were
assigned to the clerk-telegrapher to fill out his assignment and permitted the car
clerk to perform the duties of the yard clerk. This was not violative of the
Clerkst Agreement - See Award 615.
