STATE1.0NT OF CLAIM: Claim of the System Committee of the Brotherhood:
(1) That Carrier violated the Clerkst current Agreement by its action on or
about June 18, 1951, when it required Yard Clerk D. M. Temple of Shreveport,
Louisiana, to srspend that portion of his regularly assigrt~r. duties of checking
cars at the Barksdale Air Force Ease, and contracted that pcrtion of his duties
to the T&A Railway Company at Shreveport, Louisiana.
(2) That Yard Clerk D.-M. Temple be paid an additional one hour and fifteen
minutes per day for 110 days, which represents the number of regularly assigned
work days on his position between June 13 and December 1, 1951, and that he be
paid two hours for ea^h of the 20 Saturdays bet:reen J::ne :_$ and December 1, 1951.
These days do not include tho 10 working days and 3 8:turdays of his vacation
period July 23 through August 3, 1951. The time clamed to be figured at one and
one-half times his rate of
pt.y,
and to be in addition to what he has aheady been
paid during same period of time.
FINDINGS: The Board is of the opinion that the Carrier violated the Clerks'
Agreement in this instance. The only question remaining is whether
anyone was damaged or if any damage accrues to anyone in this ca.,e. The Board is
of the opinion that there were some twenty Saturdays wherein this employee,
claimant here, would have been required to check the yards on an overtime basis and
that this is the only penalty the Board can find that can be attached hereto and
that Claimant should be paid for one hour and fifteen urinates at straight time
rate to take care of the Saturdays involved.
