STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood:

(1) That Carrier violated the current Clerks' Agreement on December 20, 1952, when it failed to call Mr. R. R. Holden, for a vacancy on the 3=00 P..M., to 11:00 P.M., Yard Clerk position, Pine Bluff, Arkansas, in accordance with his seniority and the rules of the Agreement.

(2) That Mr. R. R. Holden be compensated for eight hours at one and one-half times his regular rate of pay for December 20, 1952.

FINDINGS : The Board finds that the method in which this matter was handled was not in violation of the agreement.

AWARD : Claim denied.
