STATE<`~:ENT OF CLAIM:
The particular claim in dispute is identified as follows:
"Claim of various yard office employees at Great Falls
because yardmasters allegedly performed clerical work,
Organization file 1929, Carrier file G-69-5-111."
This claim seeks unearned pay at the overtime rate for a group
of yard clerks at Great Falls. It is based upon an allegation that yardmasters
have performed clerical work, and that this constitutes a violation of the scope
rule of the Clerks' Schedule. The character of the work in question and the
circumstances under which it was done have not been disclosed by the organization, Therefore, the Carrier does not know and cannot explain what underlies
this claim.
FINDINGS: This Special Board of Adjustment upon the whole record and all the
evidence, finds that:
From the submissions and arguments, the Board finds that the
claimants have failed is their burden of proof to show that the Yardmasters, or
any other employees of the Carrier, who are outside of the Clorkst 1:greement,
have been performing clerical work which was not incidental to their duties.
Therefore, this claim will be denied.
