STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood of Railway and Steamship
Clerks, Freight Handlers,, Express and Station 2rnployes that the Carrier
violated the current agreement,
1, Y.hen they failed to properly compensate Clerk Pt. D,
Lofgren during the period June
4.
1957 up to and including June 26, 1957,
2. That the Carrier now be required to compensate hi. D,
Lofgren, Clerks for one hour each day at the rate of time and one-half for
all days commencing with June 4. 1957 and ending with June 26, 1957.
FINDINGS: This Special Board of Adjustment upon the whole record and all the
evidence, finds that:
From the submissions and arguments the Board finds that this
claimant did not perform the identical services for the Carrier as other
Clerks at the Minneapolis
Freight Yard
who were in continuous service over
a 24 hour period each day, Therefore, the Carrier did not violate Rule
No. 32(a) when this claimant was assigned hours from 9:30 a.m. to 6:30 P.m.
with a one hour period for lunch.
The facts in this docket are distinguished from the facts
in the docket which resulted in our Award No, 2. This claim will be denied.
