EMT OF CLAIM: Claim of the System Committee of the Brotherhood that,
Clerks J. McKenna, H. Goldstein and G. Pitchford, Clerks in the
Car Movement Bureau, Jersey City, N. J., be compensated on overtime basis for August 23rd to August 26th, 1955 inclusive account
not being permitted to perform assigned duties on these dates due
to Carriers use of Freight Traffic representatives to perform
claimants' assigned duties in violation of Rules 1(a), (g), 3(a),
4,
18(d)s (e)s of the Clerks' Agreevent.
FINDINGS
Because of the re-routings due to hurricane "Dianevf, the Car
Movement Bureau at Jersey City received many more inquiries from customers
than was normal. A Commercial Agent in Philadelphia spent four (Lt) days in
that office assisting in tracing cars and
answering telephone
and telegraph
inquiries. It appears that such work was normal clerical work which should
have been performed by clerical forces and simply represented an augmentation
of their regular duties.
The claim is for compensation on overtime basis, but the awards of
the Third Division, National Railroad Adjustment Board make it clear that
proper rate for work not performed is pro rata.
AWARD
Claim sustained at pro rata for the time consumed by the Commercial
Agent in assisting the clerks,
