STATEMENT CF CLAIM: "Claim of the System Committee of the Brotherhood of ttailway
and Steamship Clerk's, Freight Handlers, Express and Station
Employes that:
1. Carrier violated agreement dated June 1,
1954
when on April
27, 1956
they
blanked one day of regular relief position No. 11,
2,
Carrier shall pay Claimant Eugene W. Baird who was available and on the
extra board a days pay at Wringermants rate."
FINDINGS: The Board, upon the whole record and all the evidence, finds that:
The Carrier or Carriers and the Employee or Employees involved in this
dispute are respectively Carrier and EYnployee within the meaning of the Railway
Labor Act, as approved June
21, 1934.
The Board has jurisdiction over the dispute involved herein. The
parties to said dispute were given due notice of hearing thereon.
It is only for the trial period, June
7
to September
15, 1954,
that
the Agreement of June 1,
1954,
barred the Carrier from reducing the Ogden Laundry
work force below the level of 108 five day week positions. Accordingly, no
obligation was imposed on the Carrier by said instrument on any day subsequent to
September
15, 1954,
to maintain said number of five day positions on a seven day
basis,
AWARD: 1. The Agreement of June 1,
1954,
was not violated when regular relief
position No4 11 was blanked on April
27, 1956.

Claim denied.
