DISPUTE The Atchison, Topeka and Santa Fe Railway Company



(a) Carrier violates the rules of the current Clerks' Agreement when it fails and refuses to compensate Mr. Don Knight for holiday pay for November 25, 1954; and,

(b) Mr. Don Knight shall now be compensated for 8 hours at pro rata rate for November 25, 1954.



The Carrier and Employes involved in this diEpute are respectively Carrier and Employes within the meaning of the Railway Labor- Act as amended.



Claimant was an extra employe who was assigned and used as vacation relief on a personal record clerk position during the absence of the regular occupant on vacation November 22 to December 3s 1954.. Thanksgiving Day fell on a workday of his workweek and he claimed holiday pay which the Carrier declined.

Article II "Holidays" Section 1 of the National Agreement of August 21, 1954 confers the right to receive holiday pay on "each regularly assigned hourly and daily rated employe.1t

Claimant was an extra or unassigned employs and not a regularly assigned employe within the meaning of the holiday rule. Awards 8053, 8055 and 8056 (a11 on this property) require a denial award.
