STATER~NT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May 1, 1942,
except as amended, particularly the Scope, by assigning employee not covered by
the Rules Agreement to perform work accruing to employes of our class or craft
on May 29,
1953.

(b) H. R. Wellington, K. F. Spongberg and M. C. Sutter, Group 2
employes, be allowed eight hours pay at rate of time and one-half as a result of
this violation.
FIIQDINGS: The main stock pile of material at Brie is maintained at the Storehouse
and Car Shop and is under charge of the Stores Department employes.
A monthly inventory of material on hand is furnished the Stockmen for the purpose
of replenishing the stock as needed. This inventory is made by Group 2 Stores
Attendants whose primary duties include inventorying material and keeping stock
in order.
Gang Foremen in the Maintenance of Equipment Department maintain stock
piles of material which they have ordered from the storehouse for their respective
points and which is charged out to them and under their control. These stock piles
serve as workin,* stock at the four locations and are taken from the stock piles
as needed by Car Repairmen for current use. No Stores Department employes are
assigned at those locations.
An annual inventory of material on hand is taken at all points in the
Erie terminal for use of the Supervisor of Regional Expenditures. -This inventory
of the stock piles under control of Gang Foremen here involved has, in the past,
been made by the Foreman in charge except in the years
1949
and
1955.
Carrier
asserts without denial that on practically all divisions the annual inventory
count of stock piles such as involved herein has been for years and still is
taken by various crafts and classes~of employee among which are Car Repairmen,
Car Repairmen Helpers, Electricians, Electrician Helpers, Machinists, Gang
Foremen, Pipe Fitters and Shop Laborers. From this it appears that the annual
inventory of material charged out to and in possession of other departments is
not work which has been recognized as belonging solely to clerical employes. The
material inventory is not under their control or in their possession but it is
under the control and in possession of the Gang Foremen and we think the inventorying is properly incidental to their regular duties.
