STATEIENT Claim of the System Committee of the Brotherhood that: OF CLAIM:

(1) Carrier violated the Clerksf Agreement when it permitted and/or required Yardmasters at Cumbo, W. Va.., to perform clerical work, and

(2) That R. S. Johnson, Yard Clerk, be allowed 4 hours 59 minutes for March 1, 1956, and subsequent dates, and

(3) That W. D. Hull, Yard Clerk, be allowed 4 hours 59 minutes for April 1, 1956, and subsequent dates.

FINDINGS:

The disposition of this claim turns upon the determination of whether or not the weighing of cars is clerical work. i£ it is a sustaining award is in order. If it isn't the claim has no merit.

It is shown that the mork of weighing cars at the location involved has never
been assigned to employees covered by the Clerks' Agreement. Itatis also shown that
at other points on the property the weighing of cars is performed by employees
other than those covered by the Clerkst Agreement. Upon these facts we cannot-find
that the weighing of cars is exclusively clerical work. (See Awards 1418 and .16-89,
