Group 1 ORT Claim No. 11-27-22 is on behalf of 3. H. Browning, Temple, Texas for a "call" (three hours pro rata) account train order No. 19 being copied at (Cobel) Temple at 2:03 a.m., May 13, 1957 by Assistant Superintendent W. L. Nigh, far Train No. 75, in violation of Rule 1 (a) and 1 (e).

FINDINGS:



Mr. Browning was on duty at this office in Temple at the time the Assistant Superintendent copied the train order by phone at another point in Temple (Cobel), 2 miles distant. He was not subject to "call" within the meaning Rule 1 (e). Rule 1 (e) is a "call" rule for an employe not on duty. It is to protect him against loss of work belonging to him under Rule 1 (a) if that work is required when he is not on duty.
