Group 1 ORT Claim No. 11-27-22 is on behalf of 3. H. Browning, Temple, Texas
for a "call" (three hours pro rata) account train order No. 19 being copied at
(Cobel) Temple at 2:03 a.m., May 13, 1957 by Assistant Superintendent W. L. Nigh,
far Train No. 75, in violation of Rule 1 (a) and 1 (e).
FINDINGS:
Rule 1 (a) is applicable to this position and the train order in question..
Mr. Browning was on duty at this office in Temple at the time the Assistant
Superintendent copied the train order by phone at another point in Temple (Cobel),
2 miles distant. He was not subject to "call" within the meaning Rule 1 (e).
Rule 1 (e) is a "call" rule for an employe not on duty. It is to protect him
against loss of work belonging to him under Rule 1 (a) if that work is required
when he is not on duty.
AWARD:
Claim denied.
