STATEMENT OF CLAIM
:
1. Carrier violated the terms of the Telegraphers' Agreement when, on
December 25, 1954, and January 1, 1955, it blanked Job. No. 44 at
"DA" office in Albany, New York, and continues to blank the position on designated holidays.
2. Carrier shall now be required to pay one day's pay to Claimant
Adam Good at the time and one-half rate of the position for the
lost work on Christmas Day, December 25, 1954, and New Year's Day,
January 1, 1955.
The Carrier will also be required to compensate employes entitled
to work on subsequent designated holiday dates when Job. No. 44 is
blanked, until the practice is corrected.
OPINION OF BOARD
:
The parties had agreed to defer further action on the subject claim pending a decision by the Third Division, National Railroad Adjustment Board, in a
similar dispute involving the Southern District. Said decision has recently been
rendered. By letter dated December 8, 1958, the Organization informed this Carrier that the Employes "will comply with the decision in this case, Docket No.
TE-8117, Award No. 8539, and accordingly withdraw..." the subject claim. The
Carrier joins the Organization in requesting that this claim be withdrawn from the
agenda of Special Board of Adjustment No. 259.

Claim dismissed.
