STATEMENT OF CLAIM:
1.' Carrier violated the provisions of the Telegraphers'
Agreement when it assessed a ten-day record suspension
against the personal record of D. J. Washburn because
of a loss of $820.00 at his office at Crestwood, New
York, due to a burglary on September 17, 1957, without
just cause.
2. Carrier shall now remove the discipline and clear the
record of D. J. Washburn.
3. Carrier shall compensate D. J. Washburn two hours for
time consumed in attending hearing September 20, 1957.
OPINION OF BOARD:
Carrier recently advised the Organization that since discipline was not
assessed within ten days from completion of hearing, as required by Article
32(a) of the Agreement, it was arranging to satisfy the claim as presented.
In view of this statement, the parties jointly request that this case be
withdrawn from the Board's agenda. This request is granted.
AWARD:
Claim dismissed.
