THE ORDER OF RAILROAD TELEGRAPHERS CASE NO. 136
' 402-1/4-148
VS.
(202-59)
THE DELAWARE, LACKAWANNA AND WESTERN RAILROAD COMPANY
EMPLOYEES' STATEMENT OF CLAIM:
Claim in favor of J. J. McCauley, an extra employe for
$48.08, less the amount paid for working on Washington's
Birthday, February 23, 1959.
OPINION OF BOARD:
Commencing February 20, 1959 Claimant J. J. McCauley was assigned from
the extra board to fill a position due to the regular employee being off. On
February 23, 1959, which was recognized on the property as Washington's Birthday (a contract holiday), Claimant worked this position for 8 hours and was compensated at the rate of time and one-half. The claim is that he also was
entitled to 8 hours pay at pro rata rate as holiday pay.
Since the Claimant was not a regularly assigned employee at the time
in question, he was not entitled to holiday pay under the provisions of the
Agreement of August 21, 1954.
AWARD:
Claim denied.
