STATEMENT Claim of the System Committee of the Brotherhood that:
OF CLAIM:
(1) The Carrier violated the effective Agreement when, on
October 1,
1957,
it assigned a Blacksmith from the Roadway
Track Department instead of Water Service Employes from the Bridge and Building
Department to weld the longitudinal hand safety railing to the top of the iron
posts set in a concrete retaining wall at Poplar Bluff, Missouri;
(2)
Furloughed Water Service Repairman C. G. Mitchell and Water
Service Repairman Helper Leo Enlow each be allowed eight
hour's pay at their respective straight time rates because of the violation
referred to in Part (1) of this claim.
FINDINGS: The carrier assigned to the Bridge and Building Department con-
struction of a retaining wall at Poplar Bluff, Missouri, but then
crossed department seniority lines and assigned a track department welder to
perform some welding work. This action was a violation of the seniority rights
of Bridge and Building Department welders so the claim must be sustained.
