MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the Committee that:
1. Carrier violated the Agreement by unfairly
dismissing from Carrier service Track Foreman R. Z. Torres, as of April 18, 1975.
2. Claimant be restored to service in his
foreman's position with seniority, pass
and vacation rights unimpaired, and be reimbursed for 8 hours each work day, at his track
foreman's rate, including holidays falling
therein beginning April 18, 1975 and continuing until restored to service.
FINDINGS: The claimant entered a $7.00 daily expense allowance
under Award of Arbitration Board No. 238 on his time
cards without authorization. He was provided bunk car lodging
accommodation and was not automatically entitled to such an allow
ance.
If he considered such accommodations unsuitable he should
have filed a claim or grievance. Entry and approval thereof on his
time card, without authorization, was a failure to fulfill his re,
sponsibility as a track foreman, so his claim cannot be sustained.
AWARD: Claim denied.
