BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES

MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the Committee that:
1. Carrier violated the effective Agreement
when Trackman B. J. Sturch was unjustly dismissed by letter dated October 7, 1978.
2. Claimant B. J. Sturch shall be paid for
eight hours each work day and holiday, at the
straight time rate of pay for trackmen, to
begin on September 18, 1978, when he was with
held from service, and to continue until such
time as he is returned to work.
FINDINGS: Evidence adduced at the investigation sup
ports the charge in this case and consideration
of the poor attendance record of the claimant,
his warnings thereon and his relatively short
service the penalty of dismissal is not excessive.
AWARD: Claim denied.
