BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
versus
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT
OF CLAIM: Claim of the Committee that:
1. Carrier violated the effective Agreement
when Trackmen Clifford E. Williams, Allen L.
Nash, and Frederick C. Lincoln were unjustly
dismissed by letters dated January 9, 1979.
2. Claimants Williams, Nash, and Lincoln shall
be paid for eight hours each work day and
holiday, at the straight time rate of pay for
trackmen, to begin on January 9, 1979, and to
continue until such time as they are returned
to work with seniority rights and vacation
privileges restored, unimpaired.
FINDINGS: Evidence was adduced at theinvestigation
to sustain
the
charges against the claimants
and the offenses are generally considered to
be proper cause for dismissal regardless of
one's length of service or prior record.
AWARD: Claim denied.
